Man faces trial over jaw fracture assault charge
A NORTH Dublin man is facing trial accused of fracturing another man's jaw in an assault at a city bar.
Bryan Dunne (33) had the case against him adjourned for the preparation of a book of evidence when he appeared in Dublin District Court.
Mr Dunne, with an address at Delwood Road, Castleknock, is charged with assault causing harm to a man at Dicey Reilley's, Harcourt Street on May 15, 2012.
The court heard the DPP was consenting to summary trial of the charge at district court level.
The alleged victim was living in the UK and his father had travelled from Limerick to be in court.
A State Solicitor handed a medical report in to court. This was dated March 2013 and a more up to date report was not available because of difficulties in getting a consultation for the alleged victim.
Reading the report, he noted that the injuries to the alleged victim included a mandibular fracture and numbness to the left lower lip.
He noted that the prognosis was that the man may well fully recover but this was not guaranteed.
He decided the case was too serious to be dealt with at district court level and refused jurisdiction to deal with the charge, adjourning it to a date in September for the preparation of a book of evidence.
This means it will be sent for trial by judge and jury to Dublin Circuit Criminal Court.
