Garda had to use pepper spray on fleeing burglar

A BURGLAR tried to climb over two back garden walls as he attempted to evade gardai, a court heard.

Gary Whitley (29) refused to stop for officers, who were forced to subdue him with pepper spray.

Judge David McHugh ordered a probation report and adjourned sentencing to January.

The defendant, of Bawnlea Green, Tallaght, admitted before Blanchardstown District Court to burglary and possession of articles for use in a theft at Allendale Close, Clonsilla, on August 20 last year.

Gda John Hayes said a member of the public contacted gardai about three men who were seen at the rear of a house in the Allendale estate.

He said he was directed to a corner house, and when he went inside he saw a male running through the kitchen and into the back garden.

Gda Hayes said he directed Whitley to stop but he failed to do so, climbing over a back wall into the neighbouring property. He also dropped a screwdriver getting over the wall.

The officer said he followed Whitley over the wall, again directing him to stop.

Gda Hayes said Whitley swung at him, trying to hit him.

The garda also said Whitley tried to climb into the next garden and he was forced to use his pepper spray to effect an arrest.
