A driver lifted nearly €1,000 worth of wine from his supermarket load to take to a birthday party, a court heard.

Mihai Acasandrei (39) was caught when passing gardai saw his truck parked at a petrol station and found him transferring the wine to a van.

Judge Grainne Malone fined him €500 after hearing it was not the smartest of crimes and that Acasandrei had been naive to think he would not get caught.

The married father-of-one, of Holywell Road, Swords, pleaded guilty to stealing €950 worth of alcohol and toiletries.

Dublin District Court heard he was questioned at a service station near Donabate last May 6 when officers noticed a truck parked with the door open. Next to it was a Transit van with its door also open.

Gardai saw a man in the van popping back from the truck.

Warned

Acasandrei was then spotted moving six bottles of wine from his truck to the van.

When approached he admitted he had taken the drink for his own use.

Acasandrei had been working for a haulage company that was under contract to a store to deliver goods.

"Quite a lot of property" had already been transferred prior to the arrival of the gardai, the court heard.

The driver "blurted out that he wanted to tell the truth" as soon as the gardai came. They warned him that they needed to caution him first.

Acasandrei had swiped the alcohol to drink at a birthday party, his barrister Joe Mulreany said.

The defendant said he had no idea of his haul's true value , but had reckoned it was between €300 and €400.

He had lost his job as a result of the incident.

"It wasn't the most sophisticated criminal activity," Mr Mulreany added.
