Children win €56k over crash whiplash

THREE children, who suffered whiplash injuries when their family car was rear-ended on a motorway roundabout, have been awarded a total of €56,000 for personal injuries.

Circuit Court President Justice Matthew Deery heard that the accident happened on the Enfield bypass in January 2007.

Daniel Hopkins (10), his brother Thomas (7) and their sister Rachael (9) had each suffered neck injuries when the car, driven by their mother Jennifer, had been struck from behind.

Counsel for the children, who sued through their father, Thomas Hopkins, of Clonuff, Broadford, Co Kildare, told the Circuit Civil Court that all of the children had suffered whiplash injuries which had been painful for several years after the accident.



SYMPTOMS

The children had received treatment from their general practitioner and a consultant for recurrent and protracted symptoms which had been more problematical for Daniel and Thomas.

Judge Deery approved settlement offers made on behalf of the defendant motorist, Monica Carney of Dodsboro Road, Lucan, Co Dublin.

Daniel and Thomas were each awarded €20,000 and Rachael was awarded €16,000 which will remain invested in court funds until they are 18 years old.
