Man had stolen Dundrum Centre clothes in car claim

THIS is the man who was allegedly caught emptying bags and bags of stolen ladies' clothing and jewellery into the boot of a car.

Thomas O'Driscoll (29) is accused of stealing over €2,400 worth of clothing from River Island in the Dundrum Town Centre.

The defendant, of Richmond Avenue in Fairview, denied at Dun Laoghaire District Court charges of theft and handling stolen property.

Judge Clare Leonard adjourned the matter for legal submissions on what powers the gardai had to search the vehicle for the clothing.

Garda Danielle Farragher said she was called to Dundrum Town Centre on February 20, 2010 after security staff reported that a man and a woman were acting suspiciously.

Garda Farragher said she spoke to O'Driscoll and subsequently searched a 2008-registered Volkswagen Passat. She said the boot was filled with ladies' clothing as well as small amount of jewellery, which had been stolen from River Island.

A defence lawyer claimed the search of the vehicle was illegal as the garda had not outlined what power of search she was invoking.
