Ex Bohs' bar worker takes dismissal case
A FORMER bar manager with Bohemians Football Club has launched an unfair dismissal case over the loss of his €30,000 a year job.
Alan Brady (39), from Carnlough Road in Cabra, was employed at the Phibsboro club on a fixed-term contract.
John Smith (BL) for Mr Brady told a hearing of the Employment Appeals Tribunal that his client was made redundant on December 16, 2011.
"So Bohemians Football Club said it didn't need a bar manager over Christmas 2011. The evidence will be that was one of the busier times of the year," he told the hearing.
Mr Smith claimed that there was "an absence of fairness with regard to the overall treatment of Mr Brady".
He said that it was Mr Brady's understanding that he was "out" on December 16, and on December 17 another individual, who was an experienced bar man, was brought in to work in the bar.
Mr Smith said that around three months before his client was made redundant, a letter was sent to Mr Brady by the then-bar director - who was not present at the hearing - dated September 2, 2011. In it, the bar director said he was writing to express his dissatisfaction with his current work performance.
It contained a list of "items outstanding for several weeks" which the letter said Mr Brady had agreed to attend to.
Mr Smith said that the letter contained the line that: "Failure to immediately address the above items and to improve your overall level of performance may lead to suspension or dismissal."
Mr Smith said Mr Brady's written response to the letter, sent the same month, was "fairly robust".
Chris Brien, a former president of the club, told the hearing that the decision to make Mr Brady's post redundant would have been a board decision. "On an ongoing basis, we were looking at how to reduce costs in every area," he said.
He explained that a decision had been made to reduce the number of nights of the week that the bar was open. It would open on match nights, Friday, Saturday, and Sunday nights and for functions.
Mr Brien said that this reduction in the number of nights meant that a full-time bar manager position wasn't needed.
In addition, a number of directors said they would give their time on a voluntary basis to the bar, he said.
The hearing was adjourned until November when it will be heard over a full day.
