A shoplifter caught stealing a jacket from a display mannequin assaulted a security guard with a bottle when he was confronted.

John Gallagher (21) hit the shop worker on the arm with the bottle after he left with a high-visibility jacket and a pair of sunglasses.

The case was adjourned after Dublin District Court heard he had been under a suspended sentence at the time.

Gallagher pleaded guilty to charges of theft, assault and breach of the peace.

The court heard Gallagher went into Guiney's on North Earl Street last October 10 and took a pair of sunglasses.

On his way out, he selected a high-vis jacket from a mannequin and left with the goods, worth €26.

The security guard followed him and Gallagher became aggressive, before striking him on the arm with the bottle, which did not break. The guard was not injured.

The doorman managed to return him to the shop and Gallagher continued to be verbally abusive.

Gardai were called and Gallagher, with an address at Caretaker's Hostel, Back Lane, was arrested.


In an unrelated incident, the accused was seen "roaring and shouting indiscriminately" at people on Anglesea Street in Temple Bar at 1am last November 24.

He refused to stop when approached by gardai.

The court heard Gallagher had been given a six-month suspended sentence at Drogheda District Court for a separate offence.

Judge Michael Walsh referred the cases to that court for consideration of the activation of the suspended sentence.

Gallagher was remanded on bail.
