Pair accused of assaulting each other in New Year row

A District court judge has refused jurisdiction in a case in which two women are alleged to have assaulted each other last New Year's Eve.

Michelle Kelly (28), of Hazel- grove, Portrane Road, Donabate, is accused of assault causing harm to Michelle Noonan (23), also of Hazelgrove, last December 31.

Ms Noonan is alleged to have assaulted Ms Kelly causing her harm on the same date in the same estate.

Gda Conor Tumbleton told Judge John Coughlan at Swords District Court that the case involves counter-allegations of assaults.

He said that when he arrested Ms Kelly and Ms Noonan they both made "no reply" after caution.

Gda Tumbleton added that the Director of Public Prosecutions has directed summary disposal of the case, meaning the district court would be a suitable trial venue.

However, after reviewing medical reports and photos of both complainants' alleged injuries, the judge held that the case was too serious to be dealt with at district court level, which upon conviction can impose a maximum sentence of 12 months for the alleged offences.

This means both women could now be facing trial before a judge and jury at Dublin Circuit Criminal Court.

It has been alleged that, on the evening of New Year's Eve, a row broke out between the women over children playing in the estate.

Ms Kelly allegedly gave Ms Noonan a black eye and broke her fingernail, while it is all- eged that Ms Noonan broke Ms Kelly's nose.

After the judge refused juris- diction, he remanded both women on continuing bail to appear before the court again on December 6, when they are likely to be served with the book of evidence.

He also ordered them to have no contact with each other.
