Man who was 'strung out on drugs' slapped CDs out of shop assistant's hands
A MAN who was "strung out on drugs" and slapped a stack of CDs that then hit a female shop assistant in the face has been convicted and fined at Swords District Court.
Jason Keating (23) does not remember the incident, which happened at Xtra-vision in Skerries, the court heard.
Keating, of Ceol na Mara, Rush, pleaded guilty to assaulting the assistant and using threatening and abusive behaviour at Xtra-vision on Thomas Hand Street, Skerries, last July 24.
Gda Paul Kelly said Keating entered the DVD shop at 9.30pm and approached the assistant.
The woman was carrying a stack of CDs at the time, and Keating slapped them out of her hands. The CDs then hit her in the face.
He then began verbally abusing her.
Keating, who has five previous convictions, was arrested.
Gda Kelly said Keating has not come to the attention of the gardai since, and after he was released from custody he returned to the garda station a few days later to apologise for the incident.
Defence solicitor Fiona D'Arcy said Keating has struggled with drug addiction for a number of years, but had been cleaning up his act since 2012.
"He hadn't been in trouble since 2012 and fell off the wagon on this particular day," said Ms D'Arcy.
"He doesn't remember the incident as he was strung out on drugs and is not proud of himself.
"He has made a commitment to remain drug-free."
Judge Patricia McNamara convicted and fined Keating €200 for using threatening and abusive behaviour and convicted and fined him €250 for assaulting the shop assistant.
"I am giving you an opportunity," said the judge.
