Halle wants court to tell violent ex-lover to stay away for good
HALLE Berry plans to extend the restraining order against her ex-boyfriend indefinitely.
It is understood her legal team is preparing to go to court to get the emergency order -- due to expire tomorrow -- extended.
The move comes after her former partner Gabriel Aubry (37) -- the father of Berry's four-year-old daughter Nahla -- got into a violent row with Berry's French fiance Olivier Martinez (46) on Thanksgiving.
The row occurred as Aubry dropped Nahla off at Berry's LA home. The Oscar-winning actress got her daughter away from the scene as Aubrey attacked Martinez.
Following the fight, a judge issued an emergency order of protection to make Aubry stay at least 100 yards from Berry, Nahla and Martinez.
But the order will expire tomorrow and it seems that the 46-year-old actress is taking no chances.
It is reported that Berry will argue for the restraining order to be continued on the grounds that it is too risky for Aubry to be around daughter Nahla, Berry and her fiance.
The actress was spotted looking tired and annoyed near her Los Angeles home on Sunday as the fall-out from the Thanksgiving Day brawl took its toll.
According to sources, the male model "went completely nuts" at the French actor during Thursday's altercation.
Both men were hospitalised following the fracas.
Aubry sustained a broken rib and bruises to his face, while French native Martinez suffered damage to his hand.
Berry and Aubry split in 2010 after four years. The pair have been involved in a custody dispute.
Earlier this year Aubry petitioned a court to stop Berry from moving to France with their daughter and Martinez, saying it would limit his access to his daughter.
Berry argued that privacy laws are stronger in France and would keep Nahla safe from the paparazzi.
The judge ruled in favour of Aubry.
Talking about her custody battle earlier this year, the actress said: "There is turbulence, but this too shall pass."
Martinez and Berry put their wedding plans on hold earlier this year while the actress focused on her custody battle.
